What is Spousal Sponsorship?

A citizen and permanent resident living in Canada can bring their spouse and dependent children to Canada and live together.

Spouse sponsorship programs have some requirements that make one eligible to sponsor their spouse to bring to Canada.

 

As per the IRPR, Immigration and Refugee Protection Regulations act, Citizens and Permanent Residents of Canada can sponsor their spouse, conjugal partner or common-law partner, dependent children, parents and grandparents, children adopted from abroad and others (in exceptional cases).

What is a Conjugal & Common-law relationship?

 

Two people who have been living together in a committed relationship like sharing properties, supporting each other financially, etc., for a year or longer but are not married are considered Common-law partners in Canada.

If a couple who is not married and wants to live together as a couple but is not able to due to reasons like not yet divorced with a legal marriage partner, marriage can not be acceptable in their country (like same-sex marriage), etc. are considered as Conjugal partners in Canada.

What is the eligibility to Sponsor a Spouse?

 

1. Your age must be 18 or above.


2. As a sponsor, you will be responsible to fulfill the basic needs of your spouse or dependents.


3.An agreement will be signed between you and the Canadian government stating you are taking responsibility for your spouse, common-law, or conjugal partners’ finances for 3 years.


4. If your spouse takes any financial help from the government during the period of three years, you have to pay back to the government the whole amount.


5. If a person is found to be unsuccessful in returning the money, he will not be able to sponsor another family member until he pays the complete amount.

How to Sponsor a Spouse?

 

Spousal sponsorship can be applied in two ways- Inland sponsorship and Outland sponsorship. In both types of application, eligibility differs for sponsor and sponsee.

What are Inland and outland sponsorship?

 

Inland and outland are the types of spousal sponsorship in Canada. Inland sponsorship Canada allows spouses and common-law partners living in Canada to sponsor or get sponsored by their partners. Outland sponsorship allows spouses living outside Canada to apply for PR through a spousal sponsorship program.

 

Inland Spousal Sponsorship

 

You will fall under the Inland Spousal Sponsorship program, if

 

  1. You and your partner are living together in Canada
  2. Both have legal status or temporary visas to live in Canada

If you apply under in-land spouse sponsorship (as a sponsee), then you can apply for an Open Work Permit to work in Canada while your PR application is in process.

 

Outland Spousal Sponsorship

 

You will fall under the Inland Spousal Sponsorship program, if

 

  1. The partner to be sponsored is living outside Canada
  2. Not be in any criminal offense
  3. Minimum 18 years of age

1. If the sponsor is living in Quebec, he may have to fulfill some additional requirements.


2. In Outland sponsorship, applicants do not require a valid temporary visa when a spousal sponsorship application is in process.


3. In spousal sponsorship, applicants have to show proof of their legal marriage. They must have married in a country where their marriage is legally accepted (same sex or opposite).


4. In a case where the marriage has not been performed legally, applicants have to apply as a common-law or conjugal partner.


5. No minimum wage is required to be eligible for the spousal and dependent children sponsorship (if outland sponsorship but may be required in some cases).


6. In the fastest mode of processing, spousal sponsorship applications take around 12 months from the start to end.

No. It is not necessary for you(sponsee) to have a job offer to apply for Spousal sponsorship.

 

2. Will I be required to take a language test to be sponsored?

No. For PR through Spousal sponsorship, a language test is not a required document. But it may be required if you apply for Citizenship later.

 

3. Can I sponsor my spouse if I don’t have a job currently?

Job is not a necessary factor to sponsor your spouse. But you have to take responsibility for their expenses for 3 years after they become Permanent Residents.

 

4. Is there a limit to sponsoring spouses in Canada?

You can sponsor more than one spouse. But there are certain conditions that, like the previous spouse you have sponsored, have completed 3 years in Canada, no social assistance amount is remaining to pay back to the government, not in criminal cases or related obligations, etc.
