CRS(Comprehensive Ranking System)

CRS is a point-based system that gives scores on the basis of a candidate’s profile. Highest scored candidates get an invitation mail to further process the PR application.

Divorce Cases or Marital Issues effects in PR Process

1. If you divorce after sponsoring your spouse-

If you have sponsored your spouse, you are responsible for the basic needs of your spouse for the next three years after his becoming of Permanent Residence. This condition remains the same even if you get divorced in the middle of that time period.

2. If you are not a married couple-

If partners are not married and want to sponsor their spouses then a document of their relationship will be asked as per the common-law relationship. After that, they can sponsor their partner and submit immigration applications.
You have to show proof of your marriage or being together as a couple for 12 months or longer.
Depending on the nature of the case it can take up to 12 or more months in your visa process.

3. If you get divorced after filing your application-

Once you receive ITA, your Express Entry gets automatically updated in the Global Case Management System. Now, if some changes happen in your life, try to update it as soon as possible before submission of your application. You should have all the required documents at the time of verification. Your goal should be to keep your profile as accurate as possible.

4. If you get divorced after receiving ITA

After receiving your ITA you can not change the information you have given or related documents in support of that. If you get divorced after receiving your ITA, you have to show the legal documents or a letter of explanation (LOE) of your current relationship status. In case of the unavailability of supportive documents, you have the option to decline the ITA. In this case, your profile remains active in the Entry pool as long as it is in the valid time period.

The Conjugal Relationship

In the case of a Conjugal relationship, cohabitation is not required. When you say you are in a conjugal relationship you will be asked to give an explanation in support of your relationship status along with reasons why you are not living together.
Although, your relationship status doesn’t affect your immigration application. However, if you lie to a court of law about the length or evolution of your relationship, this may affect your immigration status.

3. LGBTQ couple

There are countries where homosexuality or same-sex relationship is not a crime and are legally & socially accepted. But still, there are many countries where people face emotional, social, and mental pressure for not being able to be open about their sexuality.

When I talk about homosexuality issues, there are many situations where couples feel underconfident while revealing their relationship. One among them, hitting my mind right now.

There were two lesbian girls who were in search of a rented room. They had a hard time finding one until they started lying about their real relationship. This is the situation in one of the big cities of the country.

Legal rights are of no use if not implemented. Canada, in terms of Human Rights and equality always comes up in front and is known for its legal policies.

Canada with multiculturalism concept always shows its interest in inviting more and more applications around the world. Apart from its environmental and technological attraction, Canada also has strong policies and organizations in the protection of Human Rights laws of its citizens.

A person can sponsor his/her spouse, partner, or child to live if he/she’s are:
1. Canadian citizen
2. A person registered in Canada as an Indian under Canadian Indian Act.
3. Permanent Resident

In the case of Same-sex partner sponsorship:

1. They must have lived together for 12 months or more in an interdependent relationship.
2. As per the common law, couples have to provide an explanation or document in favor of their statement.

With time, Canada is becoming more responsive especially for foreign visitors and those who belong to a specific community like LGBT.
